Terms of Use
Introduction
The Industrial CleanTech Platform (“ICTP”, “the Platform”), administered by the EELA Program, is a one-stop-shop supporting the cleantech and industrial energy community. The Platform responds to two core needs:
Providing an enabling space where cleantech providers, energy experts, and industrial users can meet, exchange information, and explore collaboration opportunities;
Facilitating the sharing of knowledge on up-to-date energy-efficient technologies, practices, and solutions.
The Platform is tailored to cleantech providers, energy experts, and industries seeking to
improve energy efficiency outcomes.
ICTP provides access to various features and content,
including:
Directory of energy experts
Directory of cleantech providers
Knowledge products (tools, reports, PDFs)
ICTP maintains the Platform as a courtesy to Users who choose to access it.
GENERAL
Access to the information, documents, and services on this Platform is provided as a public
service by ICTP.
Unless expressly stated otherwise, the findings, interpretations, and conclusions presented in
Platform materials reflect the views of their respective authors and do not necessarily
represent the views of ICTP, the EELA Program, or any affiliated institutions.
Extracts from ICTP materials may be used elsewhere provided that proper acknowledgement of
the source is made. If material is indicated as originating from a third-party website or
organization, permission for reuse must be sought from the originating source.
References to companies, products, or trade names do not constitute endorsement or
recommendation by ICTP.
The use or omission of particular country names or territorial designations does not imply
any judgment concerning legal status or boundaries.
PLATFORM DEVELOPMENT AND MODIFICATION
ICTP may, at any time and without notice:
1.
change, update, improve, or discontinue any part of the Platform, its materials, or any features;
2.
modify these Terms of Use or introduce additional terms;
3.
introduce or modify categories of Users and membership levels.
ICTP has no obligation to consider the needs or preferences of any User in doing so. ICTP also reserves the right to deny access to any User, suspend accounts, or remove submissions without notice if the User fails to comply with the Terms of Use.
ACCESS TO THE PLATFORM
Access to certain ICTP features requires registration and submission of a signup form.
User categories (e.g., cleantech providers or energy experts) may have different
registration procedures and profile requirements.
By accessing or using the Platform, including its
subdomains, mobile versions, and extranets, the User accepts these Terms of Use. If the User does not agree, they must discontinue use.
By creating an account, the User represents that:
1.
they are of legal age or have appropriate guardian consent;
2.
they are fully capable of entering into these Terms;
3.
if acting on behalf of an organization, they have proper authorization to bind that organization.
The User is responsible for maintaining the confidentiality of account credentials and for all activities carried out under their account. Any suspected unauthorized use must be immediately reported to ICTP.
CODE OF CONDUCT
ICTP aims to offer a safe, constructive, and professional environment.
By engaging with the Platform, Users agree to abide by this Code of Conduct.
Users must not:
Send offensive, abusive, threatening, or harassing messages;
Post defamatory, unlawful, misleading, or infringing material;
Share private, confidential, or proprietary information without authorization;
Upload files containing viruses or malicious code;
Interfere with Platform functionality or security;
Misrepresent their identity or affiliation;
Engage in spamming, advertising, or commercial solicitation without authorization.
Respect intellectual property rights;
Remain relevant, constructive, and respectful;
Avoid discriminatory, hateful, or explicit content;
Not impersonate others or imply ICTP endorsement;
Avoid sharing personal data that should not be public.
Violations may result in warnings or immediate account suspension at ICTP’s discretion.
ICTP does not endorse or pre-review User contributions but may remove content that
violates these Terms.
By posting content, Users grant ICTP a non-exclusive, worldwide, royalty-free license to
use, reproduce, adapt, display, or distribute the content in connection with the operation
and promotion of the Platform.
DISCLAIMERS AND INDEMNIFICATION
Use of the Platform and its contents is at the User’s own risk.
ICTP makes no representations or warranties, express or implied, regarding the accuracy or
completeness of the materials or features.
ICTP is not responsible for:
the conduct of any User;
reliance on any advice, opinion, or information shared by Users or third-party contributors;
content on third-party websites linked from the Platform.
Under no circumstances shall ICTP be liable for any direct, indirect, incidental,
special, or consequential damages including, but not limited to, loss of profits, data,
opportunities, or goodwill, arising out of or related to Platform use.
As a condition of using the Platform, Users agree to indemnify ICTP and its affiliates
from all claims, losses, damages, liabilities, and expenses arising from their use of the
Platform or breach of these Terms.
The User’s sole remedy for dissatisfaction with the Platform or its content is to
discontinue use.
INTELLECTUAL PROPERTY
Unless otherwise stated, ICTP grants Users permission to access, download, and copy Platform
materials for personal, non-commercial use only, subject to these Terms.
ICTP’s name, logo, and visual identity are the exclusive property of ICTP and may not be
used without prior written consent.
Users retain ownership of their own contributions but acknowledge that posted material may
become publicly accessible.
ICTP does not manage or facilitate commercial transactions between Users.
PRIVACY
The processing of personal data on the Platform is governed by the ICTP Privacy
Policy, which forms an integral
part of these Terms of Use.
LIMITATION OF LIABILITY
All Platform content is provided “as is” and “as available.”
ICTP does not guarantee uninterrupted service, error-free operation, accuracy, or suitability
of any content.
ICTP is not responsible for downtime, malfunction, or issues arising from third-party
websites linked through the Platform.
Nothing herein shall constitute or be considered a waiver of ICTP’s privileges and
immunities, which remain expressly reserved.
DISPUTE RESOLUTION
Any dispute arising from these Terms or use of the Platform shall be settled under the
jurisdiction of the courts of Vienna, Austria, in accordance with Austrian law.
ICTP is not responsible for downtime, malfunction, or issues arising from third-party
websites linked through the Platform.
The English version of these Terms prevails over any translation.
NOTIFICATION OF CHANGES
ICTP may update these Terms of Use at any time.
Changes will be posted on this page and
become effective upon posting.
