The User acknowledges and agrees that the use of the Platform and its contents and features is at the User’s sole responsibility and risk. EELA makes no warranties or representations of any kind, whether express or implied, regarding the accuracy, suitability, or completeness of the Platform, its materials, contents, or features.
User Conduct
The User further acknowledges and agrees that EELA is not responsible or liable for the conduct of any User of the Platform. EELA does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information provided by any information provider, User, or any other person or entity. Reliance on any such information is at the User’s own risk.
Third-Party Links
The Platform may contain links or references to third-party websites. These linked websites are not controlled by EELA, and EELA is not responsible for the content of any such website. Links are provided solely for convenience, and their inclusion does not imply any endorsement by EELA.
Limitation of Liability
Under no circumstances, including but not limited to negligence (whether in contract, tort, misrepresentation, or otherwise), shall EELA or the Platform be liable for any direct, indirect, incidental, special, or consequential loss, damage, liability, or expense (including, without limitation, loss of profits, revenue, opportunity, goodwill, data, reputational or economic damages) incurred or suffered by any User, or alleged to have resulted from the use of the Platform or its contents and features.
This includes, without limitation, any error, omission, interruption, delay, defect, alteration, deletion, virus or other harmful component, or any communication line failure, regardless of cause, even if EELA has been advised of the possibility of such damages.
Under no circumstances shall EELA or the Platform be liable for any direct, indirect, incidental, special, or consequential damages arising from interactions between Users or between Users and any third party, whether directly or indirectly related to the Platform.
Indemnification
As a condition of using the Platform, the User agrees to indemnify and hold harmless EELA, the Platform, and their affiliates from and against all actions, claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of the User’s use of the Platform, its materials, or its contents and features, including any claims alleging facts that, if true, would constitute a breach by the User of these Terms of Use.
Discontinuation of Use
If the User is dissatisfied with any material on the Platform or with any of these Terms of Use, the User’s sole and exclusive remedy is to discontinue using the Platform.
